Welcome to Confide. By using our service, you agree to these terms. Please read them carefully.
Eligibility: You must be at least 18 years old to use Confide. If you're using it for a company, you must have the authority to agree to these terms for that organization.
The Service: Confide provides an end-to-end encrypted form builder. These terms apply to our hosted service at useconfide.app. (Our open-source software has its own license, the AGPL).
Passkeys: We don't use passwords. You log in using passkeys (like FaceID, TouchID, or hardware keys).
Recovery Codes: When you sign up, we give you a one-time recovery code. Store it safely. If you lose your passkey and your recovery code, we cannot help you get back into your account. Your data will be lost forever.
Your Responsibility: You are responsible for keeping your devices, passkeys, and recovery codes secure.
Privacy by Design: Everything you create is encrypted on your device before it reaches us. We cannot read your forms or your responses.
Security Disclaimer: While we use end-to-end encryption, no system is 100% secure. You acknowledge that the security of your data also depends on the safety of your own devices and that zero-day exploits or localized breaches are possible.
Shared Access: In Team Workspaces, data is shared securely between members you authorize. Creators have full control over who is invited and what level of access each team member is granted.
The Golden Rule: Because we can't see your data, we can't reset your keys or recover your files if you lose access. If you lose your keys and your recovery code, your data is gone.
You agree not to use Confide for:
Moderation: Because your data is encrypted, we can't moderate content. However, we may suspend accounts based on metadata (like usage patterns) or external reports if we suspect abuse.
Payments: Some features require a paid subscription. When you upgrade from a free account to a Pro account, you are billed that day and your billing cycle starts immediately. Renewals: Subscriptions renew automatically. You can cancel anytime. Non-Payment: If a payment fails or is not made, your account will be reverted to a free account. All free account limits will be applied to your data and forms until a successful payment is made. Refunds: Generally, payments are non-refundable unless required by law. Changes: We'll give you at least 30 days' notice before changing our prices.
Export: You can export your data at any time. Deletion: When you delete your account, your data is removed from our active systems immediately. It stays in our encrypted backups for up to 7 days before being permanently erased.
Your Content: You own the content you create. DMCA: If you believe someone is using Confide to infringe on your copyright, email us at legal@useconfide.app. Because we can't see encrypted content, we can only take action on public forms or account metadata.
"As Is": We provide Confide "as is." We can't guarantee it will always be available or error-free. Liability: To the extent permitted by law, we are not liable for any amount or damages of any kind that result from the use of the service. This includes, but is not limited to, damages arising from localized device breaches, zero-day exploits, or any unauthorized access beyond our control. We aren't responsible for data loss caused by lost encryption keys. Governing Law: These terms are governed by the laws of the Commonwealth of Virginia. Any disputes will be handled in Virginia courts.
If we make major changes to these terms, we'll notify you by email or by posting a notice on our site. Continuing to use Confide means you agree to the new terms.
